Terms of Service

These Terms of Service ("Terms") govern your use of the Atlas service ("Atlas"). Atlas is a visual operations and management layer for Proxmox VE, installed on your own infrastructure. By accessing the website, creating an account or purchasing a license, you agree to these Terms. Atlas is provided by Göksel Urhan, an individual seller based in Türkiye ("we", "us").

Agreement and precedence

These Terms apply together with the Refund Policy, the Privacy Policy and the End User License Agreement (EULA). In case of conflict regarding the use of the installed software, the EULA prevails.

Product and license

Atlas is software that lets you manage your Proxmox host(s) through a visual interface and runs entirely within your own infrastructure. We grant you a non-transferable, non-exclusive license to use Atlas within the scope of your plan (update license count, personal or commercial use); detailed license terms are set out in the End User License Agreement. Open-source components are provided under their own licenses (e.g. AGPL). The product is continuously developed; features may change over time and roadmap statements are not binding commitments.

Account

You are responsible for the confidentiality and security of your portal account and license key. You agree to provide accurate, current information at registration and to be responsible for all activity under your account.

Payment, tax and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders; it processes payments, collects and remits applicable taxes, and handles customer service inquiries and returns. Subscription plans renew automatically at the end of the period unless cancelled. We may change prices; changes do not affect the current period and are notified in advance.

Update entitlement

A purchase includes access to software updates for the period paid for (12 months on annual plans). When the update period ends, the installed software keeps running on the last version you were entitled to; we do not remotely disable an installed product. On renewal, update access resumes where it left off. Update access is provided through credentials specific to your account; those credentials may not be shared.

Refunds and right of withdrawal

Refunds are subject to our Refund Policy and Paddle’s buyer terms. Because Atlas is digital content delivered immediately, at checkout you will be asked to expressly consent to immediate delivery and, to the extent applicable, acknowledge that the statutory right of withdrawal ends with that delivery; independently of this, the 14-day money-back guarantee in our Refund Policy applies. You may cancel the renewal at any time before the renewal date.

Acceptable use

You may not use Atlas for unlawful purposes, in a way that infringes third-party rights, or to harm systems. License keys and update credentials are personal; they may not be shared, transferred or duplicated. Circumventing license, verification or update mechanisms, unauthorised reproduction of closed components, or reverse engineering except as permitted by mandatory law and open-source licenses, is prohibited.

Infrastructure responsibility and operations

A purchase includes update access for the period paid for. Update access is provided through personal credentials tied to your account and is verified on our servers. Update access (the update license) is bound to the server it is installed on and applies to as many servers at once as your plan covers. To move an update license to a new server, it is first released from the server it sits on; a released server keeps running but receives no updates, and that license cannot be moved back to it. If no update license is free, no new installation link is issued; to keep more servers up to date at the same time, additional update licenses are added. If Proxmox is reinstalled, the license can be used again on the same server. When the period ends, access to new versions stops; the installed Software keeps running on the last version you were entitled to.

Intellectual property

Except for components offered as open source, all rights in the Atlas software, brand and content belong to us. Atlas is an independent product and is not affiliated with, endorsed by or sponsored by Proxmox Server Solutions GmbH. "Proxmox" is a trademark of its respective owner.

Third-party services

We use our Merchant of Record, Paddle, for payments, together with third-party service providers for functions such as email and website hosting; these providers may change from time to time and have their own terms. Content on your Proxmox servers does not pass through Atlas servers by design.

Disclaimer of warranties

The service is provided "as is" and "as available"; to the maximum extent permitted by law, no express or implied warranties are given. Infrastructure operations carry inherent risk; you are advised to take a backup or snapshot before critical changes.

Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or exemplary damages (including loss of profit, data or goodwill). In any case, our total liability is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim. Liabilities that cannot be limited under applicable law are reserved.

Suspension and termination

We may suspend or terminate your account, portal and update access if you breach these Terms or the license terms. License rights tied to transactions that are refunded or subject to a successful chargeback end in accordance with the Refund Policy and the EULA. After termination, the last installed version you were entitled to in non-refunded periods may continue to operate under the EULA.

Changes

We may update these Terms from time to time. We will give reasonable notice of material changes; continuing to use the service after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the Republic of Türkiye. If you are a consumer, the mandatory consumer protection provisions of your country of residence continue to apply, and these Terms do not limit those rights.

Miscellaneous

If any provision of these Terms is held invalid, the remaining provisions remain in effect. We may assign our rights and obligations in the event of a business transfer; you may not transfer your license without our written consent.
