End User License Agreement

Effective date: November 2026

This End User License Agreement ("Agreement") is concluded between Göksel Urhan ("Licensor") and you regarding the use of the Atlas software ("Software"). By purchasing, installing or using the Software, you accept this Agreement. This Agreement applies together with the Terms of Service, the Refund Policy and the Privacy Policy; in case of conflict regarding the use of the Software, this Agreement prevails.

Grant of license

Each license you have paid for and not refunded gives you the right to use Atlas. This right is yours and cannot be transferred to anyone else. One license is for one server: only one server receives updates at a time. A second server needs a second license. The first installation after purchase and reinstalling Atlas on the same server use no move. If a server fails or is replaced, the old server is released in the portal and Atlas is then installed on the new one. For this there are 3 moves per year for each server in the license, and every server change uses one move. A fresh Proxmox installation also counts as a server change. When the license is renewed, the moves are refilled.

Open-source components

The agent component of the Software running on the host is offered as open source under the AGPL-3.0-or-later license; that open-source license governs that component, and this Agreement does not restrict the rights it grants. All other components, including the interface, product intelligence and distribution components, are the property of the Licensor and are subject to this Agreement.

Update entitlement

If you do not renew the license, no new versions arrive; the installed Atlas keeps running on the last version you received. Atlas on the old server keeps running but receives no updates.

Free Update Plan edition

Update Plan is a free, separately distributed edition of the Software that contains the sections for monitoring and applying Proxmox updates. It is obtained by opening a portal account and accepting this Agreement; no payment is taken. You are granted a non-transferable, non-exclusive, non-sublicensable right to install and use Update Plan on up to ten Proxmox hosts per account. An Update Plan license does not include the features of the full edition, its update entitlement or the services specific to the full edition (compatibility check requests, Atlas Link, Atlas Watch portal notifications); these are obtained by purchasing a paid plan. Updates to Update Plan are provided for as long as the Licensor offers this edition; the Licensor may change the scope of the free edition or stop offering it, and the installed version keeps working. All provisions of this Agreement other than those tied to payment and purchase also apply to Update Plan. Update Plan can be installed on up to 10 servers; each server allows up to 3 server changes per year.

Restrictions

The following are prohibited: copying, distributing, renting, sublicensing or making the closed components available to third parties; sharing or transferring the license key or update credentials; circumventing or attempting to circumvent license, verification or update mechanisms; reverse engineering, decompiling or creating derivative works except as permitted by mandatory law and the licenses of open-source components; attempting to receive updates on more servers at once than you have licenses; running a current version of Atlas on an unlicensed server.

License verification and online communication

The software is designed to work without an internet connection. It connects to our servers only for license operations, update checks and package downloads; and, only if you switched them on, for watch notifications and usage statistics. The data processed over these connections is explained in the Privacy Policy. We do not remotely disable or delete your installed system. On installations without a valid license (for example after an approved refund) commercial components may become unusable and a removal option is offered in the interface; no intervention is made in your Proxmox environment or your data. Atlas checks that it is running on the licensed server. If a current version of Atlas is copied to an unlicensed server, the sign-in screen shows suspicious activity and sign-in is not possible. Proxmox, virtual machines and your data are not affected. If you have changed servers, you can release the old server in the portal and install Atlas on the new one, or write to contact@atlaspve.com; a person reviews your request.

Operations and backup responsibility

The Software is an infrastructure management tool running with root privileges. Verifying that you have current backups and rollback points (snapshots) before critical operations is your responsibility. The Software’s warnings, analyses and recommendations are decision support; they do not constitute a guarantee for your environment.

Intellectual property

The Software is licensed, not sold. Except for open-source components, all rights in the Software, brand and content belong to the Licensor. Atlas is an independent product and is not affiliated with Proxmox Server Solutions GmbH.

Term and termination

This Agreement remains in force for as long as your license is valid. Upon a material breach of this Agreement, a refund of the related purchase, or a successful chargeback, the related license terminates automatically. Upon termination you must stop using and remove the closed components. Your right of use for versions you were entitled to in non-refunded periods is preserved.

Disclaimer of warranties

The Software is provided "as is"; to the maximum extent permitted by law, no express or implied warranties are given. Infrastructure operations carry inherent risk.

Limitation of liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special or consequential damages, and our total liability is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim. Liabilities that cannot be limited by law are reserved.

Transition

These rules apply to purchases and renewals made after November 2026. A period you have already paid for continues under the previous rules until it ends.

Governing law

This Agreement is governed by the laws of the Republic of Türkiye; mandatory consumer protection provisions of your country of residence are reserved.
